These Terms of Service ("Terms") govern your access to and use of the LocalVibe™ platform and services provided by Clear Path Consulting ("Company," "we," "our," or "us"). By accessing our website, submitting our sign-up form, or using any of our services, you agree to be bound by these Terms.
If you do not agree to these Terms, you may not use our services. We reserve the right to update these Terms at any time, and your continued use of the services constitutes acceptance of any changes.
LocalVibe™ is a QR code-based customer retention and SMS marketing platform designed for local businesses. Our services include:
Starter — $79/month
Basic QR code setup, SMS follow-up sequence, and customer loyalty features.
Growth — $99/month + $99 one-time setup fee
All Starter features plus 30-day follow-up sequence, reactivation campaigns, birthday automation, and advanced analytics. The $99 setup fee covers configuration of your automation sequences.
Pro — $149/month + $299 one-time setup fee
All Growth features plus Google Review automation and custom table tent & place card design. The $299 setup fee covers the additional configuration required to integrate and activate the Google Review automation system, as well as the design of branded table tents and place cards for your business to display at your location.
All plans include a 21-day free trial. Your credit card will be charged at the end of the trial period unless you cancel before the trial expires. Subscriptions are billed monthly and renew automatically. Payments are processed securely by FastPayDirect.
Your 21-day free trial begins on the date you complete payment setup. Please note that due to the A2P (Application-to-Person) SMS registration process required by carriers, your SMS services will typically go live within 7 days of sign-up. The remaining 14 days of your trial represent full active service.
You may cancel your subscription at any time before the trial ends to avoid being charged. To cancel, contact us at [email protected]. Cancellations take effect at the end of the current billing period; we do not provide prorated refunds for partial months.
The $99 Growth plan setup fee and the $299 Pro plan setup fee are non-refundable once the respective setup process has begun.
By using LocalVibe™, you agree to comply with all applicable SMS regulations, including the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and carrier requirements. You agree that:
Violation of these terms may result in immediate suspension of your account without refund.
All business SMS messaging requires A2P 10DLC registration with carriers. Upon sign-up, we will initiate the registration process on your behalf. This process typically takes approximately 7 business days. You acknowledge that SMS services will not be active until registration is approved, and that we are not responsible for delays caused by carrier review processes.
All content, branding, software, and materials on the LocalVibe™ platform are the property of Clear Path Consulting and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
To the maximum extent permitted by law, Clear Path Consulting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill, arising from your use of or inability to use our services. Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.
The LocalVibe™ platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components. Results from using our platform (including customer retention rates and Google review counts) will vary and are not guaranteed.
These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Clear Path Consulting is registered, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.
